             Effective August 2, 2006, a new law, created under New York State Public Health Law, permits you to designate in writing a person who will ultimately decide how your remains will be disposed (burial, cremation, embalming, etc.) and indicate any special directions desired.  In the event that no individual is named in writing, the new law provides those individuals that will be charged with the decision in descending priority.  The new statute recognizes domestic partners as individuals who may have control over the disposition of a decedent’s remains.

 

             This law is likely to alleviate disagreements among family members and better ensure that your wishes are followed.  This document can be drafted by an attorney as part of your estate plan in connection with other important documents such as the Health Care Proxy, Power of Attorney and Living Will.
